In this morning's Perseverance Counts for Something Department, opponents of Donald Trump's fast-rising, 46-story condo hotel at Spring and Varick Streets are filing an appeal to stop it, even though it's half done and units are on the market. The SoHo Alliance filed a brief yesterday with the obscure Board of Standards and Appeals (BSA), which has the power to overrule the Department of Buildings. The claim is the same one that opponents have made all along but that has failed to get any traction: the that big tower was given a permit as a transient hotel, which is permitted under zoning, but is being marketed as an investment or long-term residence. The email announcing the suit has some nice language, though, about how it opens the door to doom: "More crass glitzy commercialism will follow. Welcome to the Wild West!" Construction continues while the appeal is hear.
