Opponents of the Forest City Ratner Atlantic Yards project between Fort Greene and Prospect Heights in Brooklyn have filed a "motion for relief" of last month's Appellate Division decision. That decision, which followed ongoing demolition work on the site, found no conflict of interest in the fact that an environmental lawyer that represented Forest City Ratner had also represented the Empire State Development Corp. (Plain English: They're asking the court to hear their appeal.) The motion to the state's highest court, the Court of Appeals, was filed by Develop Don't Destroy Brooklyn and 15 co-plaintiffs. What this means, we're not sure, except that it's probably a warm up for much litigation to come on eminent domain and the project Environmental Impact Statement, a draft of which is due in July.
