Anybody that thought the recent Supreme Court rejection of the Atlantic Yards eminent domain suit was the last litigation news of the summer was wrong. An appeal has been filed by opponents of the project in an entirely different case, the challenge to the environmental impact review. That case rejected by a New York State Supreme Court judge in January, so 26 plaintiffs have filed an appeal with the State Appellate Court. Opponents argue the initial review was flawed for a long list of reasons. A finding in their favor would require a new environmental impact analysis and a new vote by the Public Authorities Control Board. Opponents of the 22-acre development believe the project has changed so much that it requires a new approval anyway. No word on when any other lawsuits will be filed.
