After the jaw-dropping news yesterday that the U.S. Attorney's office in Manhattan had filed suit against developer AvalonBay for not conforming to rules on wheelchair accessibility in new apartments (and that other developers may soon be targeted), the real estate overlords must now plan their defense. They may argue that NY's Local Law 58, which sets the ground rules for wheelchair regulations in new apartments, is actually more stringent than the Fair Housing Act, which is what they are alleged to have violated.
