A New York State appellate court has dismissed a suit brought by opponents of Brooklyn's Atlantic Yards development that sought to challenge the use of eminent domain to seize property in the project's footprint. A date with the Court of Appeals may be next, but the Observer notes, "The favorable court decision narrows the legal options for opponents of the project." Over on Atlantic Yards Report, the mood is one of acceptance: "The Atlantic Yards eminent domain case was always a long shot in state court." Only 237 lawsuits left to go. [NYO; AYR]
