Extell is taking its $16 million typo case to state court after the state Attorney General and U.S. Court of Appeals told the developer to refund 41 Rushmore buyers' deposits. Extell will ask the court to review Andrew Cuomo's "arbitrary and capricious" ruling in the infamous Rushmore case, which is based on tenants' claims that the building's first closing missed the 2008 deadline set in the contracts.
