Brick Underground reports that a Boston condo buyer has lost a secondhand smoke lawsuit against her former real estate agent. The asthmatic buyer claimed the agent lied about the smoke smell in the apartment, blaming it on the seller, rather than on the downstairs neighbor. In the trial, the agent denied having discussed the smoke with the buyer, and the jury rejected the buyer's claim. But Brick Underground theorizes that brokers will now be more careful about how they respond to secondhand smoke questions. And perhaps local plaintiffs will have better luck? [Brick Underground]
