The battle over the Prospect Park West bike lane hit the courts in March, in the first anti-lane lawsuit since 1980. Bike lane opponents accused the Transportation Department of putting out misleading information about the lane's safety and conspiring with the pro-bike lane crowd to end local opposition. Well, the verdict is in, and?case dismissed!
Supreme Court Justice Bert Bunyan dismissed the suit yesterday, the Brooklyn Paper reports. Transportation Commissioner Janette Sadik-Khan released a statement calling the lane's opponents "dead wrong" and their lawsuit frivolous. But the lawsuit was actually dismissed on something of a technicality, according to the Post?the court ruled that the lawsuit was filed too late under the state law that allows challenges to "arbitrary or unfair" government actions. Bike lane opponents are still considering an appeal.
