The Katan Group's lawsuit to stop the sale of the old Domino factory has been thrown out by the State Appellate Court, leaving Two Trees free to close on the $180 million deal. The suit was dismissed by a judge at the end of September for a slew of reasons, then an appeals court gave Katan a glimmer of hope. But yesterday's decision firmly ends the legal battle, and Two Trees can soon start construction. The developer has not revealed its final building plans, or whether there will be affordable housing.
