Parents at P.S. 163 on West 97th Street recently filed a lawsuit to stop construction of Jewish Home Lifecare, directly adjacent to the school, West Side Rag reports. The nursing facility's new location was approved by the New York State Department of Health last year, following a lengthy environmental review signing off on the move. Nevetheless, opponents argue that the construction harms will include "acute and prolonged excessive noise that are totally inconsistent with a learning environment, lack of fresh air in the classrooms mandated by City code, air fouled by toxic dust released into the air during construction and dangerous traffic." Bruce Nathanson of JHL, on the other hand, claims that his organization "has gone above and beyond standard industry practice and regulatory mandates to assure that PS 163 and the surrounding neighborhood is not adversely affected by construction."
